Terms of Service
These Terms of Service ("Terms") govern your use of the Day One Dad mobile application ("the App"), provided by Backbone Built LLC ("we," "us," or "our"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Who Can Use the App
You must be at least 18 years old and able to form a binding contract to use the App. The App is intended for parents and caregivers. By using the App, you confirm you meet these requirements.
2. Important Medical and Safety Disclaimer
Please read this section carefully.
Day One Dad provides general educational, informational, and supportive content for new fathers. It is not medical advice and is not a substitute for professional medical care, diagnosis, or treatment.
- The content, guidance, milestones, and suggestions in the App — including anything provided by the AI Coach — are general in nature and may not apply to your specific situation. Babies and families differ, and developmental information is approximate.
- Always consult a qualified healthcare professional — such as your pediatrician, doctor, or your partner's healthcare provider — for any questions about your baby's health, your partner's health, your own health, feeding, sleep, or medical decisions.
- Never disregard or delay seeking professional medical advice because of something you read or received in the App.
- The App does not provide emergency services. If you believe there is a medical emergency or that you or anyone else may be in danger, call your local emergency number (such as 911) immediately.
- The AI Coach is an automated tool that can make mistakes or provide incomplete information. Do not rely on it for medical, legal, or other professional decisions. Use your own judgment and consult professionals.
You use the information in the App at your own discretion and risk.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Provide accurate information when creating your account, and keep it up to date. Notify us at support@dayonedad.app if you suspect unauthorized use of your account.
4. Subscriptions, Billing, and Free Trials
The App may offer paid subscriptions that unlock certain features.
- Billing. Subscriptions are billed through your Apple App Store account. Payment is charged at confirmation of purchase.
- Auto-renewal. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period, at the rate disclosed at purchase.
- Free trials. If a free trial is offered, any unused portion is forfeited if you purchase a subscription during the trial. If you do not cancel before the trial ends, the subscription will begin and you will be charged.
- Managing and canceling. You can manage or cancel your subscription in your Apple App Store account settings. Deleting the App does not cancel your subscription.
- Refunds. Purchases are handled by Apple and are subject to Apple's refund policies. We generally cannot issue refunds directly; please direct refund requests to Apple.
- Price changes. We may change subscription prices; changes will not affect your current billing period and will be disclosed as required.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of these Terms;
- Attempt to access accounts or data that are not yours, or interfere with the App's security or operation;
- Reverse engineer, copy, or redistribute the App or its content except as permitted by law;
- Misuse the AI Coach (for example, to generate harmful, abusive, or unlawful content);
- Use the App in any way that could harm us or other users.
6. Intellectual Property
The App and its content (including text, design, guides, and features) are owned by Backbone Built LLC or our licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-transferable, non-exclusive license to use the App for your own personal, non-commercial use. You may not copy, distribute, or create derivative works from the App's content without our permission.
7. User-Provided Information
You retain ownership of the information you provide (such as your profile and Coach messages). By providing it, you grant us a license to use it as needed to operate and provide the App to you, as described in our Privacy Policy.
8. Disclaimer of Warranties
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that any content is accurate or complete.
9. Limitation of Liability
To the fullest extent permitted by law, Backbone Built LLC and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of (or inability to use) the App, your reliance on any content, or any decisions you make based on the App. To the extent we are found liable, our total liability will not exceed the amount you paid us for the App in the twelve months before the claim, or $50, whichever is greater.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless Backbone Built LLC from any claims, damages, or expenses arising from your misuse of the App or violation of these Terms.
11. Termination
We may suspend or terminate your access to the App if you violate these Terms or for other legitimate reasons. You may stop using the App and delete your account at any time from within the App.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date. Significant changes may be communicated within the App. Your continued use after changes take effect constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of the United States and the state in which Backbone Built LLC is organized, without regard to conflict-of-law principles. Any disputes will be handled in the courts located there, unless otherwise required by applicable law.
